Application Process & Forms

Jersey

There are four classes of telecommunications licence in Jersey:

  • Class I licence is for those telecoms operators that have no discernible impact on the competitive market;
  • Class II licence is for those applicants without Significant Market Power (SMP);
  • Class III licence is for those applicants with SMP; and
  • General Class licence is for cases where there is a need for a licence but where, in the opinion of the JCRA, a formal application is too rigorous for the requirement. There is no need for an application or for notification to be made, but the licensee is required to know the limitations and responsibilities of the General Class licence.

Guernsey

For those wishing to apply for a fixed telecommunciations licence in Guernsey, OUR document 02/09R sets out the procedures for applying for a licence to provide telecommunications services or to establish, operate and maintain a telecommunications network in the Bailiwick of Guernsey. It briefly outlines those services that require a licence and provides references to more detailed information documents to assist interested parties in considering whether or not they require a licence.

 



Licence Fees

Guernsey Fixed Telecommunications Licence Fees

Application Fee
The application fee for a Guernsey fixed telecommunications licence is £2,500 and should be submitted along with the application form published in Document OUR 02/09R.

Annual Fee
Fixed telecommunications licensees must also pay an annual fee over the term of the licence they hold. These fees are set as follows: 

for companies with relevant turnover of less than £150,000, the annual fee is £500 per annum.
 
For companies with relevant turnover of greater than £150,000 per annum the annual fee is set at 1.4% of relevant turnover.

Radio Spectrum Fee
Where a telecommunications licensee uses radio frequency spectrum to provide any part of its network, it may be necessary for the licensee to pay spectrum fees to Ofcom, the UK regulator responsible for allocating frequency spectrum in Guernsey. Information is available from the Ofcom website.

Guernsey Mobile Telecommunications Licence Fees

Application Fee

The application fee for mobile telecommunications licences is set at the time that a competitive or other licensing process is run for mobile licences and is designed to cover the cost of the licensing process. One such process was run in Guernsey in 2002/3 and the method for setting the application fee was described in the information memorandum, Document OUR 02/30. That licensing process resulted in the award of a 3G and a 2G mobile licence to Wave Telecom Ltd and the total application fee paid by the licensee was £250,000.

Annual Fee
Mobile telecommunications licensees must also pay the same annual licence fee that is payable by fixed telecommunications licensees and these are calculated on the same basis as for the fixed licences.

Radio Spectrum Fee
Mobile telecommunications licensees use radio frequency spectrum to provide their networks and must also pay the appropriate spectrum licensing fees to Ofcom, the UK regulator responsible for allocating frequency spectrum in Jersey and Guernsey. Information is available from the Ofcom website.
